AGREEMENT BETWEEN USER AND DEBBIE HARTMANN COACHING (DH Creations PTY (LTD).

Web Site and content known as “Debbie Hartmann Official” (www.debbiehartmannonofficial.com) contained therein (collectively the “Content”) is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Content constitutes your agreement to all such terms, conditions, and notices.

MODIFICATION OF THESE TERMS OF USE

Debbie Hartmann Coaching reserves the right to change the terms, conditions, and notices under which the Content is offered, including but not limited to the charges associated with the use of the Debbie Hartmann Coaching programs or Content. Any such changes shall be effective immediately upon being posted to the Debbie Hartmann Official Web Site.

COURSES 

Debbie Hartmann Coaching does not verify, vet, or guarantee that any participant of a course is qualified to take such course; and no refund will be provided in the event that a participant fails to properly satisfy themselves of the appropriateness of a particular Debbie Hartmann Coaching Official course / class prior to enrollment.

Debbie Hartmann Coaching course / class content, and any related completion requirements, are subject to change from time-to-time, at the sole discretion of Debbie Hartmann Coaching. No change in Content or completion requirements will entitle participants to a refund, except in the sole discretion of Debbie Hartmann Coaching.

USE OF COMMUNICATION SERVICES

The Debbie Hartmann Coaching Official offerings may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

Restrict or inhibit any other user from using and enjoying the Communication Services.

Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.

Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

Violate any applicable laws or regulations.

Debbie Hartmann Coaching has no obligation to monitor the Communication Services. However, Debbie Hartmann Coaching reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Debbie Hartmann Coaching reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Debbie Hartmann Coaching reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Debbie Hartmann Coaching’s sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. INDEMNITY AND RELEASE

To the fullest extent permitted by law, you agree to release, indemnify and hold Debbie Hartmann Coaching and its affiliates and their officers, employees, directors and agents harmless from any from any and all losses, damages, expenses, including reasonable attorneys’ fees, rights, claims, actions of any kind and injury (including death) arising out of or relating to your use of the Debbie Hartmann Coaching Official Web Site, any Submissions, your connection to the services, your violation of these Terms of Use or your violation of any rights of another. If applicable, you waive any statue or doctrine which provides that: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor” or any similar or comparable statute or doctrine.

IN NO EVENT SHALL DEBBIE HARTMANN COACHING’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID DEBBIE HARTMANN COACHING IN THE SIX (6) MONTHS PRIOR TO MAKING A CLAIM, OR, IF GREATER, ONE HUNDRED DOLLARS (USD $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE OR WITH THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

TERMINATION/ACCESS RESTRICTION

Debbie Hartmann Coaching reserves the right, in its sole discretion, to terminate your access to the Debbie Hartmann Coaching Official Web Site and the related services or any portion thereof at any time, without notice.

GENERAL

These Terms of Use constitute the entire agreement between you and Debbie Hartmann Coaching and govern your use of the Debbie Hartmann Coaching Official Web Site, superseding any prior agreements between you Debbie Hartmann Coaching with respect to the same. You also may be subject to additional terms and conditions that may apply when you use affiliate or third party services, third party content or third party software. These Terms of Use will be governed by the laws of South Africa applicable therein, and you hereby consent to the exclusive jurisdiction and venue of the courts in Gauteng, South Africa, in all disputes arising out of or relating to the use of Debbie Hartmann Coaching Official Web Site and/or any courses / classes accessed therein. In the event that a similar provision cannot be deemed to replace and supersede the offending provision, then the offending provision shall be deemed severed to the minimum extent necessary, and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Debbie Hartmann Coaching with respect to the Debbie Hartmann Coaching Official Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Debbie Hartmann Coaching with respect to the Debbie Hartmann Coaching Official Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in the English language.

COPYRIGHT AND TRADEMARK NOTICES

All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Debbie Hartmann Coaching Official Web Site, are copyrighted unless otherwise noted and are the property of the Debbie Hartmann Coaching and/or a supplier to Debbie Hartmann Coaching. Any rights not expressly granted herein are also reserved by Debbie Hartmann Coaching.
